Excellence UK Ltd (t/a Aylah Fine Jewellery) will be referred to as "we", "our", "us", “Aylah” “AFJ” throughout this page and affiliated pages. Users of this website will be referred to as “you”, “your”, “user”,“users”, or “customers”.

1. Acceptance of Terms

We are a website offering jewellery products and services. By accessing or using our website (http://aylahfinejewellery.com/) in any way, you agree to be bound by these Terms & Conditions, and all applicable laws and regulations. If you do not agree to these Terms & Conditions, please do not use our website.

Kindly read through these terms and conditions before using our website as your use of the website will signify your agreement to be bound by them.

2. Changes to Terms

We may update or modify these terms and conditions from time to time without prior notice. Any changes will be posted on this page with an updated revision date and take immediate effect upon updating. We encourage you to review these terms and conditions periodically to stay informed of any updates. Your continued use of the website after any such changes will constitute your acceptance of the updated terms and conditions,

3. Eligibility

To use our website, you must be at least 18 years of age or have the legal capacity to enter into binding contracts. By using our website, you represent and warrant that you meet these eligibility requirements.

4. Products and Services

We sell jewellery products through the website. All descriptions, images, and prices of products are subject to change without notice. While we strive to provide accurate product information, we do not guarantee the accuracy, completeness, or reliability of any product descriptions, images, or pricing. If a product is listed at an incorrect price due to typographical or technical error, we reserve the right to cancel any orders placed at the incorrect price.

5. Order Acceptance and Payment

  • All orders placed through the website are subject to acceptance by us. We reserve the right to refuse or cancel any order for reasons such as product availability, errors in pricing or product information, suspected fraudulent activity, or any other reason.
  • Payments must be made in full before any products are shipped. We accept various payment methods, including credit cards, debit cards, and other online payment systems (displayed at checkout) All payment transactions are subject to the terms and conditions of the payment provider.

6. Shipping and Delivery

  • We will ship products to the address provided by you at checkout. Shipping fees and delivery times vary depending on the destination and the shipping method selected.
  • While we make every effort to ensure timely delivery, we are not responsible for delays caused by shipping carriers or customs processing.

7. Returns and Refunds

  • We offer a 14 day return policy. If you are not completely satisfied with your purchase, you may return it within the specified period for a refund or exchange, subject to our return policy.
  • To qualify for a return, the product must be unused, undamaged, and in its original packaging, and returned with diamond/gemstone certification, failure to return diamond/gemstone certificate(s) will result in the customer incurring a fee of £350 for certificate replacement. Some items, such as bespoke, custom-made or personalised jewellery, or any special requests, are not eligible for return, including engraved items.

8. Intellectual Property

  • All content on this website, including but not limited to images, designs, trademarks, logos, text, and videos, is owned or licensed by Aylah Fine Jewellery and is protected by intellectual property laws.
  • You may not use, reproduce, or distribute any of the content on the website without our express written permission.

9. User Accounts

  • You may be required to create an account to place an order on our website. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorised use of your account or any other security breach.

These terms and conditions in addition to your use of this website, shall be governed by and construed in accordance with the laws of the UK, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the UK courts. Your use of this website constitutes your acceptance to the exclusive jurisdiction of UK courts over any legal proceeding, legal action or lawsuit arising from use of this website or Aylah Fine Jewellery’s terms and conditions.

15. Payments, Orders & VAT

- Any order placed with Aylah Fine Jewellery, including via the website, over the telephone or in person, is subject to your acceptance of and compliance with these terms and conditions. Aylah Fine Jewellery reserve the right to reject an order.

- Aylah Fine Jewellery accept payment via the following methods, and are able to reject payments that do not comply with the following list:

  • Debit and Credit cards
  • MasterCard and Maestro
  • Bank transfer
  • Cash payments
  • PayPal
  • Stripe

- Aylah Fine Jewellery does not offer payment plans. At your time of order, a minimum deposit of 50% will be taken from you. We expect you to pay the complete and full amount when collecting your order. Please contact [email protected] or your consultant with queries if you feel your circumstance may be different.

- For Items ordered from outside the UK and then shipped outside the UK we do not charge UK VAT on those items. They will be subject to Tax and Duty of the country it is being shipped to. This will need to be paid by the customer to the courier company when it enters the countries customs.

16. Pricing

Pricing

- We aim to keep any information on this website as accurate as possible, but will not be held accountable for errors, typographical error, human error or error due to technical issues. In the event pricing information is incorrect or outdated, we reserve the right to change and correct such prices. In such instances, we will not honour sales based on the incorrect pricing.

- In some instances, Aylah Fine Jewellery will include information from third parties on this website. We are not responsible for the accuracy, reliability, trustworthiness or any other factor of this information. This information may include (but is not limited to) pricing. To the fullest extent permitted by UK law, Aylah Fine Jewellery will not be held liable for third party content or information.

- Aylah Fine Jewellery reserves the right to change our pricing without prior notice. Changes made to pricing will have immediate effect, unless otherwise stated. This will not affect previous purchases or prices already agreed. In some instances, however, prices may differ from quotations due fluctuating markets and subsequent costs. In such an event, you will be informed by your point of contact at Aylah Fine Jewellery.

- Any price reductions will be made at the sole discretion of Aylah Fine Jewellery and our sales staff during or after consultation, although this is unlikely as high value for money is offered across all our products.

17. Aylah Fine Jewellery will not be liable for any indirect, consequential or incidental damage of any kind, under any circumstance.

While most material used is developed by Aylah Fine Jewellery, credit will be given to materials sourced externally.

Aylah Fine Jewellery has the right to bar users or terminate sessions at our sole discretion, when users infringe the outlined policies as well as terms and conditions, as per the Digital Millennium Copyright Act (DMCA) and other applicable UK law.

All prices displayed on our website, displayed in-store or quoted to you Include Value Added Tax (VAT). Non-UK residents, tourists etc will not be able to reclaim VAT added to their/your orders upon leaving the country as per amendments to the Retails Export Scheme 2021.

- Content and information on this website may be sourced from third parties. To the fullest extent permitted by UK law, Aylah Fine Jewellery will not be held liable for third party information, which may include inaccuracies or errors.

- Links to third party websites or contact details should be opened with caution, and at your own risk. Although Aylah Fine Jewellery feels the third parties we work with or mention are usually trustworthy, we cannot control, monitor or ensure the safeness of third party websites, content, links, information or other products of third parties. We accept no liability for damages caused by such third party links or information.

Order Approval and cancellation

Receipt of an order confirmation message from Aylah Fine Jewellery only confirms that your order request has been received. Customer orders are not accepted by Aylah Fine Jewellery until the time they have been processed and approved at our head office. Aylah Fine Jewellery is not obligated to complete a customer order, and reserves the right to cancel products or services to any customer for any reason at any time. The customer’s sole remedy in such cases will be the full or partial refund of any funds that we have collected in reference to the canceled products and/or services.

Delivery of goods & Bespoke Orders

- For bespoke orders of Fine Jewellery, Engagement and Wedding rings and any other bespoke creation there is a lead time of 5-14 weeks depending on the order and the time of the year. During festive and holiday periods and the weeks leading up to them the lead time can increase and there may be delays on orders. The bespoke process also usually includes CAD renders which can take up to 2 weeks for the first version. Any subsequent changes requested on the CAD renders can take 1-2 weeks. So this can make the creation time of a bespoke ring take longer.

- Although we make every attempt to deliver goods both in-store or via post, within the estimated timeframe, there is a possibility unforeseen circumstances may delay delivery of goods. Aylah Fine Jewellery does not warrant or guarantee the delivery date and shall have no liability to you for any loss, damage, expenses or other claims that you may incur as a result of a delayed delivery.

- Once an order is ready you have up to 90 days to clear any balance remaining on the order and then collect it or have it posted to you. If the order remains with us for more than 90 days from when the order is ready unless specifically agreed upon in writing to [email protected] with us and the total balance of the order is cleared, the order will be put into stock and sold to cover our expenses in creating your order. From that point on your order will no longer be your property and you will not be eligible for any compensation for your order.

- Once an order is placed and a deposit or full payment has been made, either online or in-store, your order will be put into production unless you contact us in writing via email to [email protected]to let us know to put your order on hold or to cancel it. If your order is made ready, the previous mentioned condition will become applicable.

- All our orders are crafted by hand using top quality craftsmen to ensure the highest quality product. We try to ensure each item we create for our customer is exactly to the specification of customers order. But since each item is handcrafted there is a slight margin for difference.

- Upon collection if a customer finds an obvious error in their item as per their order, which is outside of the slight margin for error, Aylah Fine Jewellery will do its best to rectify this error as soon as it can without any additional cost to the customer. Depending on what error needs to be fixed the lead time may vary. Your jeweller/consultant will inform you of this.

- Aylah Fine Jewellery is in no way obliged or liable to offer any damages, discount or refund for any bespoke orders that have been delayed or need to be amended due to an error in manufacturing.

- On occasions when customers cannot pick up their order in person, a delivery service is available. We send orders via Royal Mail Special Delivery Guaranteed (Next Day Service) and FedEx Priority Service, both tracked and signed for, for proof of delivery. Please be aware you may be required to send proof of identity before shipment and will be required to sign for your delivery. It is therefore important that you are available to receive the delivery in person or should specify an alternative arrangement. - For your protection, Aylah Fine Jewellery always:

  • Insures and registers all items for their full value.
  • Requires that all deliveries are made to a physical business or home address only. We do not ship to P.O. box addresses.

International shipments can be processed online. Customs processes and import duties are the responsibility of the customer; please check with your local customs office for information. Contact us with any international shipping questions.

Aylah Fine Jewellery is committed to timely delivery for your order. However, delivery delays due to inclement weather conditions, carrier delays or incorrect addresses are beyond our control. Shipping fees are non-refundable. An alternative shipping method may be used when deemed appropriate to reach your target destination and target delivery date. On the rare occasion that your order is tampered with or lost during shipment, you must report this to Aylah Fine Jewellery within 7 days of receiving your tracking number.

For insurance reasons we cannot reroute packages after they have shipped from Aylah Fine Jewellery .

4.3.2 Upon receiving your item either in-store or via post, you become the sole owner of the item, and the item is held at your own risk. We are not liable for loss, damage or destruction once received by you. See our Insurance advice outlined in our Manufacturer’s Warranty.

4.3.3 The packaging we use for deliveries is discreet, and we do not write phrases such as ‘Aylah Fine Jewellery’ or ‘jewellers’, for security and discretion purposes. We ask that, in the event of returning an order by post, you do not write phrases on the packaging that could indicate the value of the contents. Instead, the package should be addressed to your jeweller/consultant, not ‘Aylah Fine Jewellery’, followed by our store address. You can find out more information in our Returns Policy section.

4.3.4 If based in the UK, Aylah Fine Jewellery pays for postage of your order to your address but does not cover the cost to post the order back to us unless the product is found to have a manufacturing flaw. This also included for resizing, returns or alterations that you may want for your order.

4.3.5 For international postages there is a fee charged to a customer for this. All postages back to Aylah for any reason including resizing, returns or alterations are at the expense of the customer. Also any customs duty fees that may become applicable on the postage is also the expense of the customer.

Bespoke

A bespoke order is any jewellery or ring order that is custom made as per the design requested by the customer. If the design does not exist on Aylah Fine Jewellery’s website at the time the order was placed it would be considered a bespoke order. Existing designs that are on our website that have been modified in any way on request by the customer is also considered a bespoke order.

Any order with a diamond or coloured gemstone, whether purchased loose to later be set in a ring or piece of jewellery or set in a ring or piece of jewellery that is 2.00 carats or larger if earth mined/natural or 5.00 carats or larger if lab grown will be considered as a bespoke order as well. If a diamond is a fancy colour diamond that is earth mined/natural and 0.20 carat or larger in size or a lab grown if it is 1.00 carat or larger in size, whether purchased loose to later be set in a ring or piece of jewellery or set in a ring or piece of jewellery will also be considered a bespoke order.

Any ring that has been engraved by customer request would be considered a bespoke order.

Any wedding band made to order as per your request would be considered a bespoke order.

Resizing

- All sizes and measurements of the rings and pieces of jewellery are approximate. However, we try to ensure that the sizes and measurements are correct. If you do not know your ring size, please select “Unknown” as your ring size during the ordering process, and we will manufacture the ring in a standard ring size (between K and L). As soon as you receive the ring and are able to determine the correct size, you can return it to us for a free resizing. This does not apply to bespoke rings.

- Most of our rings can be made smaller/larger free of charge within 120 days of purchase. This does not apply to bespoke rings. In order to resize your ring, you need to return the ring to us within 120 days after receiving it. Some rings can be resized, others have to be produced anew from scratch. If a ring has to be sized up or down more than 3 to 4 sizes it may have to be produced anew and this would not be covered by our free resize. The cost would be determined by our sales team. In the case of bespoke rings, a resizing is at our discretion. Resizing a ring can take up to 14 working days.

- All our resizing is done by hand and resizing a ring carries a small risk of the ring being damaged during the resizing process. Though we do our best to rectify any issues that come during the resizing process, in some cases the damage done during the resizing of a ring would not be able to be fixed and in that case the ring would need to be remade.

We cannot guarantee against unforeseen issues/damages that a ring may incur during resizing of a ring and so do not take any responsibility for sentimental loss if a ring needs to be remade due to any damage incurred during the resizing of it.

- If you have any engraving done on your ring this will likely be damaged during the resizing process. If you want the ring to be re engraved this would be chargeable.

Also the government hallmark on the ring may be damaged during a resizing. If you want the ring to be re hallmarked this is also chargeable.

- Any postage back to us and then postage back to the customer for resize is at the customers expense.

- The terms for resizing outside the aforementioned 120 days depend on the item(s) selected and are as follows:

Engagement Rings:

For plain band or non-diamond or non-gemstone set ring, a resizing of two sizes smaller or larger than the original size is possible for a fee. If the resizing exceeds two sizes from the original size ordered, the ring may require to be made from scratch for which corresponding costs will apply. The price will be confirmed after consulting our sales team.

Diamond-set or gemstone-set engagement rings (including bespoke rings) must be assessed in order to ensure whether they can be resized, or whether they need to be remade for which costs will apply. This will be confirmed after consulting our sales team at [email protected] or at 020 3196 1630

Eternity Rings:

Full eternity rings – Due to the nature of the setting, these rings cannot be resized. If the size needs to be changed a new ring would need to be made and charges for this would be applicable. Please contact our sales team to discuss alternative options for your ring.

Half eternity rings – Due to the type of setting, all rings must first be examined to see whether a resizing is possible or whether a ring has to be created anew. The price will be confirmed after the assessment. Please contact our sales team at [email protected]or at 020 3196 1630

Wedding Rings:

Simple wedding rings can be resized for a fee that is payable after an assessment (except for rings with a special surface and engraving). Diamond-set or gemstone-set wedding rings must be inspected prior to resizing to ensure that the nature of the setting allows a resizing.

Cocktail Rings:

Due to the nature of the individual designs, please contact our sales team at [email protected] or at 020 3196 1630 to find out if a resizing is possible.

Bespoke rings:

Bespoke rings can be resized free of charge within 60 days of collection/receipt, provided that a resizing of the respective ring and its design and specifications is possible. Upon receiving your request, we will check whether a resizing is possible and discuss it with you. The resizing may result in additional costs that shall be borne by you. This also applies if the ring has to be made anew from scratch if it cannot be resized as desired. You will be informed about any additional costs in advance. It will then be clarified whether the size change should be carried out.

Returns/Exchange/Refunds

Online orders

14 day returns from date of receiving item. Certain items are excluded from this such as bespoke rings. Please note once item is ready we will contact you to either send to your address or for you to pick it up. The 14 day returns policy starts from that date. If you don't collect item or tell us to hold off on sending item it will cut into the 14 days you have to return the item.

Online orders that have special requests for quick turnaround or a bespoke change will be considered to be a bespoke order.

For loose diamonds or gemstones the return time is 14 days from date of the stone being available and us contacting you to tell you it is ready for in-store pickup or postage.

If a customer has returned a ring they ordered as per the 14 day return policy and a new ring design or some change to the current ring design is requested and a new ring is made for the same customer this ring will not covered by the return policy. This ring will not be returnable, exchangeable or refundable.

In-store/Stock Mount/Bespoke/Quick Turn Around Orders

We do not offer any returns on an in-store or virtual purchase in which we are using a ring or jewellery mount that is ready or almost ready in/for store stock. The same is applicable for a bespoke order or an order which is a quick turnaround. A quick turnaround would be an order requested to be ready in less than 6 weeks. You can speak to the sales person about a potential exchange of your order for something of equal or greater value. There will be charges involved to restock the item that were incurred during the production of the item.

We try our best to retain most of the value of any bespoke item made by us that your are looking to exchange but if you are looking to change the bespoke ring setting for a different one then most of the times the current setting may need to be scrapped. Whatever the scrap value of that setting is would go toward the new setting. Discuss with your sales associate for further details.

If you get CAD (computer aided design) Renders made for your order and you cancel your order, £300 would be non refundable to cover the charges to make these. If you also get a Resin Mould made then that would be another £200 that would be non refundable. That amount is per CAD design and Resin Mould. Each additional design and or mould you make would be an additional no refundable charge. CAD renders can take up to 2 weeks for the first version. Any subsequent changes requested on the CAD renders can take 1-2 weeks.

We do not offer any refunds on orders made In-store with quick turn around or Bespoke orders. Exchanges are also at the discretion of management and on a case by case basis.

Production

All our orders are crafted by hand using top quality craftsmen to ensure the highest quality product. We try to ensure each item we create for our customer is exactly to the specification of customers order. But since each item is handcrafted there is a slight margin for difference.

Ring crafting is a delicate process that takes time and care. We make our rings in London using local craftsmen and are hand set the entire process to make a ring usually takes 6-14 weeks depending on the final design that a customer selects.

Any ring requested to be made in less than 5 weeks would be considered a quick turnaround order and will be considered a bespoke order unless otherwise agreed in writing with the sales person, therefore non-refundable.

The due date that we state on an invoice is one that we work towards but as our rings are handcrafted there can be unforeseen complications and delays in the production process which means we do not have the ring ready by the due date. This only happens in rare cases but at the same time this is a delicate process which cannot be rushed if we are to maintain the quality of the product.

We are not responsible for any financial or other losses a customer may incur due to not getting a ring by a certain date.

Submissions

You acknowledge and agree that any content you provide Aylah Fine Jewellery, including but not limited to questions, comments, suggestions, ideas or any other information will be deemed non-confidential and shall become the sole property of Aylah Fine Jewellery. Aylah Fine Jewellery will, therefore, own exclusive rights, including all intellectual property rights to this content, thus entitling the company to the unrestricted use and dissemination of these materials for any commercial purpose without any acknowledgement or compensation to you.

Marketing

Aylah Fine Jewellery may photograph and/or film any piece of jewellery that is manufactured by us for use as marketing material on social media platforms, websites, youtube or other online platforms. If you do not want your particular piece of jewellery to be used by us for marketing please let us know at the time you purchase the item with us.

Data Protection and Information Supplied by You

In the course of its business, Aylah Fine Jewellery needs to gather and use certain information about individuals. This will include clients, suppliers and other business contacts, and employees and prospective employees, as well as other people that we have a relationship with, may need to contact, or with whom we need to deal.

Our Privacy Policy describes how this personal data is collected, processed, transferred, handled and stored in order to meet the requirements of data protection law, in particular the General Data Protection Regulation (GDPR). We recognise that, not only must we comply with the principles of fair processing of personal data, we must also be able to demonstrate that we have done so.
